Indonesian couples who wish to get married abroad need to prepare all the related issues. Of course, it's more than just preparation for your passports and visas. It's the legal issues! You need to pay attention to the difference of legal system between Indonesian law and the law of the country of which your marriage take place.

The pre-departure preparation should include the certifications of your legal status from Indonesian government institutions such as Civil Registry Office, Department of Justice, and Department of Foreign Affairs. It certifies that you are legally free to marry.

Within 1 (one) year after you return to Indonesia, Indonesian Marriage Law stipulates that you must register your marriage with the Civil Registry Office. It will make your marriage legal in Indonesia.

Upon registration you will get a certificate stating that you have reported your overseas marriage. The registration is very important if you want to apply for foreign birth certificate for your child, purchase property in Indonesia and get loan or credit from the bank. The notary public or the bank in Indonesia usually require a marriage certificate issued by the Indonesian authorities.

Asep Wijaya is currently hold the position of Managing Director of Wijaya & Company (www.wijayaco.com), a full-service Indonesian law firm, principally engaged with the provision of wide-range legal services to international clients in Indonesia.
